1. These Terms and Conditions

These Terms and Conditions apply to all transactions on The Three Accessories website. Please read them carefully. They do not affect your statutory rights.

We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted onto the site. You will be asked to read and accept the Terms and Conditions each time you place an order, to ensure that you are familiar with the most current ones.

Please note that these terms (including prices and returns policies) apply only to purchases made from the Three Accessories website (www.accessories.three.co.uk). The Three Accessories website is separate from www.three.co.uk -and is operated by Kondor Limited (Kondor Headquarters, Christchurch Business Park, Radar Way, Christchurch, Dorset, BH23 4FL, "we" or "us") trading as Three Accessories, on behalf of Hutchison 3G UK Limited, trading as Three (“Three”). Purchases on this site are from Kondor Limited, not Three.

2. Our Contract

You will have an opportunity to check and correct any input errors in your order up until you submit your order by clicking the Submit Order button on the Order Confirmation page.

If your order is out of stock, you will be unable to purchase this item until it shows in stock on the website.

We may decline all or part of your order for any reason, in which case an e-mail will tell you so.

We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method. Please note that products, prices and offers in our stores may differ from those featured on this site.

After submitting an order to us we will give you an Order Reference Number and details of the products you have ordered. We will send the same details to you in an e-mail (our first e-mail). Please note that this e-mail is an acknowledgement, only and not an acceptance of your order.

Finally, we will send you an e-mail confirming the dispatch of your order.

Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the products ordered unless we have notified you that we do not accept your order.

3. Prices, Description and Payment

All prices and charges on this site are shown in UK pounds sterling. They include any VAT payable and free standard UK delivery (3-5 working days)

The total cost of your order will be the total price of the products and services you order, which will be set out clearly in your Shopping Basket before you submit your order.

Prices, offers and products are subject to availability and may change before (but not after) we accept your order. In this instance, we reserve the right to decline your order. If something becomes unavailable we may offer you an alternative.

We try very hard to ensure that all information on this site is accurate.

We monitor our website to ensure that it is, as far as possible, error free. However, there may be instances where product description, image or pricing errors may occur. If we find any errors such as these after you have submitted an order to us, we will contact you to let you know the correct information and ask you whether you still wish us to fulfil your order based on the correct information. We shall be under no obligation to fulfil an order for a product which was advertised as incorrect. We shall give you the option of confirming the order at the correct information or if you so choose, to cancel the order altogether. If you cancel and have already paid for the goods in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms.

We will try to contact you using any of the details you gave us when you placed the order and will leave a message for you to contact us where we can, but if we are unable to reach you, or we don’t hear back from you after leaving a message then we will treat your order as cancelled.

We accept payment by Mastercard, Visa, Delta and Switch/Maestro. We unfortunately do not accept American Express, Diner's Club, Corporate or Business Cards. Payment is deducted when we process your order.

Please be aware that you will only have three attempts to enter the correct card information when purchasing items from this site due to our fraud prevention requirements. Each rejected payment attempt creates a "shadow" payment which is logged on our site and with your card supplier. Please note that no money will be taken from your card in this instance, and the "shadow" record will drop off your account normally within 7 days but may take up to 30 days.

4. Age Requirements

If you order a product with a minimum age requirement, by ordering you confirm that you are of the required age.

5. Delivery

We offer free standard UK delivery on all orders (3-5 working days.) Upgraded Next Day Delivery can be selected at an additional charge of £4.95.

Deliveries are to UK only. Please allow extra time for deliveries over bank holidays, sale periods and deliveries to remote areas and Scottish islands.

Delivery must be to the address at which your payment card is registered, which must be in the United Kingdom (note: this excludes the Channel Islands). Please make sure you keep the receipt enclosed with your goods.

6. Delivery Times

Delivery times are calculated in standard working days - i.e. Monday to Friday inclusive. If you order after 3.00pm, the next working day will be considered the first working day. In the case of bank holidays, please allow an extra two working days.

We aim to deliver within 3-5 working days but this may increase during busy periods. Please allow up to 15 days before reporting non-delivery of your purchase.

We do everything we can to meet the delivery times specified in this section. However, occasionally delivery times may be affected by factors beyond our control and therefore they cannot be guaranteed. Deliveries are to UK only. Please allow extra time for deliveries over bank holidays and sale periods and deliveries to remote areas and Scottish islands.

Orders below £20 are by Royal Mail untracked post. Any order over £20 is sent recorded delivery using Royal Mail or other couriers. We cannot guarantee the use of any particular courier.

If you are out when the delivery is made, the courier will take it back to their local depot and leave a card through your door advising that they called and asking you to contact them for re-delivery, rejection or collection.

Next Day Delivery:

If ordered before 3pm Next Day Delivery will be within 24 hours to all major centres. Delivery to any remote regions can take up to 48 hours.

We are unable to guarantee delivery on any specific day as delivery may be prevented or delayed beyond our reasonable control; including without limitation;

  • a) Fire;
  • b) Severe weather conditions;
  • c) Industrial strike or labour disputes; and
  • d) Delay by any government or public or local authority

7. How we Deliver

If your order includes more than one item, we will try to send these to you in one box. If your items do not fit into one box, or part of your order is available sooner, the delivery will arrive in separate boxes, possibly on separate days.

8. Tracking Your Delivery

If your order is being delivered by courier our third email will contain a link to the couriers website and a tracking number, so that you can use it to track your order right to your door.

9. Missing, Damaged or Incorrect Orders

We try very hard to ensure that you receive your order in pristine condition. If you do not receive all your products, please check whether they may be being delivered separately (see "How we Deliver", above) and whether they have been despatched (see "Tracking Your Order" and "Tracking Your Delivery", above).

Our offices are open Monday-Friday 08:30 to 17:30 during these days will respond to your query within 24 hours. Please allow up to 72 hours for a response from an email sent from Friday to Sunday.

Please note: This website and the customer care process are solely managed by Kondor Ltd and Three will not be able to advise you in relation to any order placed or product purchased through this accessories website.

11. Cancellations and Returns

You have entered into a “Contract to Purchase” if you have pressed the buy button on the website and, or given your payment details. We normally only deduct payment upon shipment or when an order is processed through our systems.

You have the right to cancel this contract within 30 days without giving any reason. The cancellation period will expire after 30 days from the day, on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the total order of goods.

To exercise the right to cancel, you must inform of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail).

You can also electronically fill in and submit the cancellation form on our website at http://www.kondor.co.uk/cancelorder/ . If you use this option, we will communicate to you an acknowledgement of receipt of such a cancellation by e-mail without delay.

Returns made direct to Three stores or Three.co.uk will not be accepted.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

Please note that headphones, earphones or Bluetooth headsets of any type are non-refundable due to hygiene reasons if the packaging is opened or the seals are broken in any way. This does not affect your statutory rights at all, or if returned under warranty and the goods are found to be defective.

We cannot cancel your purchase when:
(a) The seal has been broken on any software including games;
(b) The goods were a special order to your specification.

We will make the reimbursement without undue delay, and not later than:
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (If earlier) 14 days after the day you provide evidence that you have returned the goods

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods to Three Accessories Returns Dept, Kondor Headquarters, Christchurch Business Park, Radar Way, Christchurch, Dorset, BH23 4FL, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days have expired.

The product must be complete, including packaging, instruction, accessories and any free items.

You will have to bear the direct cost of returning the goods.

If, the goods, by their nature, cannot normally be returned by post: You will have to bear the direct cost of returning the goods; or if the cost of returning the goods cannot reasonably be calculated in advance: You will have to bear the direct cost of returning the goods. The cost is estimated at a maximum of approximately £20.00 for UK Mainland deliveries and collections. Should we need to arrange for the collection of the goods, then this fee will be charged to you, or deducted from any refund.

This returns policy applies only to purchases made online from this accessories website. This accessories website is separate from Three’s website, www.three.co.uk and as such, any items purchased from us, must be returned in accordance with these Terms and Conditions. No items will be accepted for return via Three, including for the avoidance of doubt, at their retail stores.

12. Return of Faulty Goods

The following are guidelines. Wherever possible we will respond to your individual circumstances.

All Original Manufacturer products come with a 1 year warranty and may be returned if faulty to Kondor. Please contact our administration team at accessories@three.co.uk Some manufacturers offer extended warranty terms of 2 or more years. Please check the manufacturer’s website or any relevant documentation received with your purchase to check the relevant period.

If there is a fault with your product within 12 months of delivery (or other defect with your order), we will normally offer a prompt repair or exchange. We will always offer you the choice of an exchange or refund if the fault occurs within 28 days of delivery.

To qualify for a refund or exchange the product must be:

  • in otherwise "as new" condition, subject to reasonable wear and tear due to the period of time that may have elapsed from purchased; and
  • complete with any accessories and free gifts offered with it (and, if possible, the original box and packaging).

Please return the product to Three Accessories Customer Services Dept, Kondor Headquarters, Christchurch Business Park, Radar Way, Christchurch, Dorset, BH23 4FL.

Any refund due to a fault or other defect will include a refund of the applicable delivery charge. We will also pay for the costs of collecting goods for replacement or refund.

This promise does not cover faults caused by accident, neglect, misuse or normal wear and tear. For consumable items (e.g. non-rechargeable batteries) the guarantee period is three months from delivery.

Any refund due to a fault or other defect will include a refund of the applicable delivery charge.

This returns policy does not affect your legal rights.

13. This Website

This website is run by Kondor Limited under licence from Hutchison 3G UK Limited.

We, our licensors and our suppliers own the copyright, trademarks and all other intellectual property rights in all material and content on this website. Any usage, downloading, copying, publishing, transmission or otherwise means of making available of any of the material or content is strictly prohibited.

You may not create any link to this website without our prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.

14. General

These terms and conditions and all transactions relating to this website are governed by English law unless you live in Scotland in which case, it will be governed by Scots Law. Each of us agrees to only bring legal actions about this agreement in a UK court. We do not accept amendments to these terms and conditions.

15. Errors & Omissions Excepted

Every care is taken to ensure that all information on this web site is present and correct. But there may still be errors on this web site. If you find an error or omission, please let us know, and we will correct it as soon as possible after verification.

We apologise for any inconvenience that may be caused, but we cannot always offer the exact described product at the specified price, if errors and / or omissions are present.

16. Compliance with laws

The website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the website and any transactions conducted on or through the website.

While we will use reasonable endeavors to verify the accuracy of any information we place on the website, we make no warranties, whether express or implied in relation to its accuracy. The website is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the website, or any transaction that may be conducted on or through the website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, or reliability of the website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products. This does not affect your statutory rights as a consumer.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with these Terms and Conditions for:

  • any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
  • any loss of goodwill or reputation; or
  • any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these Terms and Conditions.

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence.

18. Severance

If any part of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of these Terms and Conditions.

19. Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

20. Survival

Each provision of these Terms and Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

You agree and warrant that you shall not submit any content:

  • That is known by you to be false, inaccurate or misleading;
  • That infringes any third party's copyright, patent, trademark, trade secret or any other intellectual or proprietary rights or rights of publicity or privacy;
  • That breaches any law, statute, regulation or ordinance (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
  • That discloses private information of any third party, including without limitation, addresses, phone numbers, email addresses, national insurance numbers and credit card numbers, or otherwise violates the rights of any third party, including without limitation, privacy rights;
  • That is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or harassing to any individual, merchant, partnership or corporation;
  • That impersonates, or misrepresents your connection with, any entity or person ,
  • For which you were compensated, paid money or granted any valuable consideration by any person;
  • That includes any references to email addresses, contact information or phone numbers, or other websites; or
  • That contains any computer viruses, worms or other potentially damaging computer programs or files.

You agree you will be solely responsible for the content of your submission, and any comments you make. You shall be solely liable for any damages resulting from any breach by you of this agreement or from any harm resulting from your submission. We do not represent or warrant that any content submitted by customers are accurate, and or that it is free from mistakes, omissions, falsehoods, defamation, obscenity, pornography or profanity.
